22.4.1 Overview
New Source Performance Standard (NSPS) regulations set uniform emission limitations for certain industrial categories or sub-categories of sources[1]. New Source Performance Standard (NSPS) regulations [40 Code of Federal Regulations (CFR) 60] include categories of stationary sources, which “cause, or contribute significantly to, air pollution which may reasonably be anticipated to endanger public health or welfare.”[2] Each New Source Performance Standard (NSPS) regulation specifies what types of sources are subject and applicability dates.
22.4.2 NSPS Identification
Capital letters are used to identify the New Source Performance Standard (NSPS) and lowercase letters, if present, represent amendments and revisions. These NSPS regulations only apply to facilities or equipment constructed or modified after the applicability date. For example, the New Source Performance Standard (NSPS) Subpart K – Standards of Performance for Volatile Organic Liquid Storage Vessels (Including Petroleum Liquid Storage Vessels) has two sections:
- Subpart Ka which was the original New Source Performance Standard that applies to certain storage tanks for which construction commenced after May 18, 1978[3].
- Subpart Kb applies to certain storage tanks for which construction, reconstruction, or modification commenced after July 23, 1984[4].
